5.3 Prohibited Use of the AI Chat

You may not:

  • Use the AI chat for any unlawful purpose
  • Attempt to manipulate the system through prompt injection, jailbreak attempts, or automated requests at abnormal volume
  • Use the AI chat to generate content for resale, redistribution, or commercial training of other AI systems
  • Submit personal data, payment details, credentials, or other sensitive information through the chat interface

5.4 Data Handling

  • Chat conversations may be logged and stored for service improvement, abuse prevention, quality assurance, and product development
  • Logs may include the messages you send and the responses you receive

5.5 Liability for AI Output

Carhacker OÜ accepts no liability for any damage, loss, injury, or financial harm resulting from actions taken in reliance on AI-generated content. The disclaimers in Sections 3, 4, and 6 apply in full to all AI-generated responses.

6. Limitation of Liability

To the maximum extent permitted by applicable law, Carhacker OÜ and its operator shall not be held liable for:

  • Damage to vehicles
  • Incorrect diagnostics or failed repairs
  • Failed coding, adaptations, or ECU modifications
  • Financial losses
  • Personal injuries
  • Loss of data or software issues
  • Outcomes based on AI-generated content
  • Any indirect, incidental, or consequential damages arising from use of the website or its services

This applies regardless of whether the content was free, paid, or generated by AI, and whether the loss arises in contract, tort, or otherwise.

Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law, including mandatory EU consumer protection rights.

7. Digital Products and Pro Access Membership

7.1 License Grant

When you subscribe to Pro Access or purchase any digital product, you are granted a non-transferable, non-exclusive, non-sublicensable license to access the content for your own personal, non-commercial use.

You do not acquire ownership of any content.

7.2 Pro Access Subscription

Pro Access is a recurring monthly subscription service.

  • Price: €10 per month, or as displayed at checkout
  • Billing: Automatic recurring monthly payment via Stripe
  • Renewal: Your subscription renews automatically each month until cancelled
  • Access: Continues for the duration of your active and paid subscription
  • New content: Added regularly and unlocked automatically while your subscription is active

By starting a subscription, you authorise us, through Stripe, to charge your payment method on file at the start of each billing cycle.

7.3 Cancellation

You may cancel your Pro Access subscription at any time through your account dashboard or via the Stripe customer portal.

After cancellation:

  • No further charges will be made
  • Access continues until the end of your current paid billing period
  • No partial refund is issued for the unused portion of the billing period

7.4 Lifetime Members

Members who purchased Pro Access under the previous lifetime pricing model retain permanent access at no further cost. Their access is not affected by the subsequent introduction of the monthly subscription model.

7.5 Prohibited Use

You may not:

  • Resell or redistribute content
  • Share login credentials with third parties
  • Upload, mirror, or otherwise republish content on other platforms
  • Use content for commercial training, classroom instruction, or AI model training without prior written permission

Violation may result in immediate account termination without refund.

8. Payments, Renewals and Refunds

8.1 Payment Processing

Payments are processed via third-party payment providers, currently Stripe. Carhacker OÜ does not store full payment card details. Payment processor terms apply in addition to these Terms.

8.2 Failed Payments

If a recurring payment fails:

  • Stripe will automatically retry the payment over the following days according to its standard retry policy
  • During this period your access may continue temporarily
  • If all retry attempts fail, your subscription will be cancelled and access will be revoked

8.3 Refund Policy

  • For one-time purchases (where applicable): no refunds are issued after 14 days from the date of purchase
  • For subscriptions: cancellation applies going forward only. No refunds are issued for the current billing period, for any past billing periods, or for any unused portion of a paid subscription
  • EU consumers retain any statutory rights under applicable consumer protection law. Such requests must be sent in writing to info@iamcarhacker.com within the applicable statutory period and will be handled in accordance with EU law

8.4 Pricing, Currency and VAT

  • Prices are displayed in EUR unless otherwise indicated
  • Applicable VAT or sales tax, where required, is calculated and charged at checkout based on your location
  • We reserve the right to change subscription pricing for future billing periods. Existing subscribers will receive reasonable advance notice by email before any price change applies to them

9. Affiliate Links

This website contains affiliate links.

  • We may earn a commission if you purchase through an affiliate link
  • This does not increase the price you pay
  • Opinions and recommendations remain independent and based on personal experience and testing

Affiliate participation does not guarantee accuracy, fit, or suitability for your vehicle. You remain solely responsible for verifying any product is appropriate before purchase.

10. Intellectual Property

All content on this website, including:

  • Text and written content
  • Images and graphics
  • Videos and audio
  • Diagrams and procedures
  • Branding, logos, and trade dress
  • Aggregated AI chat outputs insofar as they incorporate our content

is the intellectual property of Carhacker OÜ, unless stated otherwise.

You may not copy, reproduce, modify, translate, adapt, or distribute content without prior written permission.

11. Account Termination

Carhacker OÜ reserves the right to:

  • Suspend or terminate accounts at our discretion
  • Restrict access to content
  • Remove users who violate these Terms

This includes (without limitation) account sharing, redistribution of paid content, abuse of the AI chat service, attempts to circumvent payment, or violation of any provision of these Terms.

Termination for cause does not entitle you to a refund.

Carhacker OÜ is not responsible for:

  • Accuracy
  • Privacy practices of third parties

13. Changes to These Terms

For material changes affecting active Pro Access subscribers (such as pricing changes or significant service modifications), reasonable advance notice will be provided by email or in-account notification.

It is your responsibility to review these Terms periodically.

14. Governing Law and Disputes

These Terms and Conditions are governed by the laws of the Republic of Estonia, without regard to conflict of law principles.

Any disputes arising from or in connection with these Terms shall be resolved through the competent courts of Estonia.

This does not affect mandatory consumer protection rights granted to EU consumers under the law of their country of residence. EU consumers may also use the European Commission’s Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr
